ORDERS:
ORDER OF REMAND
This matter comes before the Administrative Law Court (ALC or Court)
pursuant to the
appeal of Troy McClain, in inmate incarcerated with the Department of Corrections (Department).
The Appellant alleges that the Department wrongfully upheld a charge of “Threatening to Inflict
Harm on an Employee and/or Members of the Public” on his Step 2 grievance form when he was
originally charged with a drug-related offense. In its Motion to Remand filed on June 2, 2004, the
Department requests that this matter be remanded to the Department so that it may re-issue an
appropriate final agency decision.
IT IS THEREFORE ORDERED that this appeal be REMANDED to the Department for
it to re-issue an appropriate final agency decision within thirty (30) days from the date of this Order.
AND IT IS SO ORDERED.
