Freedom of Information Act (FOIA) Policy
As an agency of the state of South Carolina, the South Carolina Administrative Law Court (Court) complies with the South Carolina Freedom of Information Act (FOIA).
All FOIA requests for records in the custody of the Court must be in writing and may be submitted by email or U.S. Mail at the addresses below:

Upon receipt of a written request for public records under FOIA, the Court will determine if the records are available and/or exempt from disclosure under section 30-4-40 of the South Carolina Code (as amended) or other state and federal laws. The Court will notify the requester of this determination within ten (10) business days for records less than two years old, or within twenty (20) business days for records more than two years old.
If the Court determines that the requested records are available and not exempt from disclosure, the records will be provided as set forth in FOIA.
Please note that the Court can only provide copies of records that are in its custody. If your FOIA request pertains to records held by another state agency, please send your request directly to that agency.
Freedom of Information Act (FOIA) Fee Schedule
According to sub 30-4-30(B) of the South Carolina Code (as amended), FOIA requests are subject to reasonable fees for the search, retrieval, and redaction of records, as well as fees for providing copies of documents.
⦁ Fees for a search, retrieval, and redaction of records will not exceed the prorated hourly salary of the lowest-paid staff member who has the necessary skills and training to fulfill the request.
⦁ The current rate for paper copies of records is $0.50 per page. If an electronic version of a record is available, and the requester elects to receive the record electronically, then there will be no charge for an electronic copy. Also, if the requested records are not in an electronic format, and our agency agrees to transfer the documents to an electronic format, a fee for the staff time required to transfer the document to an electronic format is customarily charged.
⦁ The Court may require a deposit not to exceed 25% of the total anticipated cost of furnishing records before searching for and/or copying records pursuant to a FOIA request.
