FINAL ORDER AND DECISION

This matter was heard on February 28, 2002 at 10:00 AM at the Administrative Law Judge Division. Notice of the time and place of the hearing was given to all interested parties. During the testimony, it became apparent that the Protestant had received incorrect information concerning the address of the proposed location. Protestant was under the impression that the application was for a new location, not a renewal of an existing license.

Protestant then agreed to withdraw his protest. There being no genuine case in controversy, this matter is dismissed and the Respondent is directed to issue the retail off premises beer and wine permit to the Petitioner.



And it is so Ordered.
