ORDER OF DISMISSAL

The above-captioned appeal regarding Appellant Mary Bethune’s determination of disability by the South Carolina Department of Health and Human Services (Department) was filed with the Administrative Law Court (Court) on June 28, 2004. On July 8, George R. Burnett, attorney for the Department, filed a Motion to Dismiss in which he set forth that this matter is not yet ripe for appeal as the Hearing Officer remanded this matter to the Medical Eligibility Unit to make a determination of eligibility, and that, in effect, the Appellant had won her case below. On July 14, 2004, a phone conference was held on the Respondent’s Motion to Dismiss in which Ms. Bethune agreed to withdraw her appeal so that this matter may be remanded pursuant to the Hearing Officer’s Order of Remand. Footnote Therefore,

IT IS HEREBY ORDERED that this matter is dismissed.

AND IT IS SO ORDERED.
