ORDERS:
ORDER OF REMAND
This matter is before the Administrative Law Court (“ALC”) pursuant to the petition for
injunctive relief filed by Charles Sullivan, an inmate incarcerated with the Department of Corrections
(“Department”). In his petition, Sullivan states that he has not received a response from the
Department regarding his Step 2 Grievance. Sullivan requests that the ALC assist him in obtaining
a response from the Department.
On June 21, 2004, the Department filed a Motion for Remand in this matter. In its Motion,
the Department states that Sullivan filed this injunctive matter with the ALC prior to receiving a final
agency decision regarding his Step 2 Grievance. The Department states that it has reviewed the
conviction of the inmate disciplinary infraction challenged by Sullivan in his Step 2 Grievance and
has found several procedural errors. The Department requests that the ALC remand this matter to
it so that it may overturn Sullivan’s conviction and restore any lost good time. Accordingly,
IT IS HEREBY ORDERED that this matter is remanded to the Department for the issuance
of a final agency decision regarding Sullivan’s Step 2 Grievance within sixty (60) days of the date
of this order;
IT IS FURTHER ORDERED that this docket is closed; when the Department issues its
final decision, if Sullivan feels he is aggrieved by that decision he needs to address it through a new
grievance;
AND IT IS SO ORDERED.
