ORDERS:
ORDER OF DISMISSAL
By a Motion to Dismiss filed April 13, 2004, Respondent South Carolina Department of
Health and Human Services (Department) moved to dismiss the above-captioned matter as not ripe
for appeal. In particular, the Department argued that the case was not ripe for appellate review
because its hearing officer had not rendered a final decision in the matter, but had remanded
Appellant’s case to the Charleston County branch of the Department for the reevaluation of his
claims. By a letter filed April 29, 2004, Appellant informed this tribunal that he had received the
Department’s motion and that he had “no objection to the dismissal of my appeal while my case is
being under further review by the DHHS.” Therefore, as the Department’s motion has merit and as
Appellant does not object to the motion,
IT IS HEREBY ORDERED that the Department’s Motion to Dismiss of April 13, 2004,
is GRANTED and this matter is DISMISSED.
AND IT IS SO ORDERED.
