ORDERS:
ORDER OF DISMISSAL
The undersigned Administrative Law Judge (ALJ) issued the Order for Prehearing Statements for the above matter on October 10,
2000. Both parties were to file Prehearing Statements on or before October 30, 2000. Respondent South Carolina Law Enforcement
Division filed its Prehearing Statement with the Administrative Law Judge Division (ALJD) on October 25, 2000.
By letter dated and mailed by certified mail on November 2, 2000, the ALJD notified Petitioner that his Prehearing Statement was
overdue and extended the deadline to file to fifteen (15) days of receipt of the letter.
As of the date of this Order Petitioner's Prehearing Statement has not been filed with the ALJD.
Pursuant to ALJD Rule 23, a default occurs in a contested case when a party fails to respond or otherwise prosecute or defend, or fails
to comply with any interlocutory order of the ALJ. An ALJ may dismiss or dispose of a contested case adversely to the defaulting
party.
IT IS THEREFORE ORDERED that this matter is dismissed with prejudice.
AND IT IS SO ORDERED.
