ORDERS:
ORDER OF DISMISSAL
This matter is currently pending before the South Carolina Administrative Law Judge
Division. This matter involves the denial of the Petitioner’s renewal of an on-premises beer and wine
permit and sale and consumption (minibottle) license by the Department of Revenue based on a public
protest as to suitability of the location by Kelly Dougherty, Chris and Lisa Maloney and Kirsty
Sutton. Based on the Agency Transmittal and Prehearing Statement sent by the Department, but for
the public protests, the permit and license would have been granted. By letter received by the Court
on April 8, 2004, the aforementioned Protestants withdrew their protests. Because the Department
would have granted the permit but for the protests, and the protests have been withdrawn, it is
hereby:
ORDERED that this matter is dismissed with prejudice; and
IT IS FURTHER ORDERED that the Department of Revenue issue an on-premises beer
and wine permit and consumption (minibottle) license to the Petitioner for the location at 227 St.
Phillip St., Charleston, South Carolina.
IT IS FURTHER ORDERED that my previous Order and Notice of Hearing is hereby
rescinded due to the dismissal of the matter.
AND IT IS SO ORDERED.
