ORDERS:
ORDER OF DISMISSAL
In the above-captioned matter, the Adult Protective Services Division (APS) of the South
Carolina Department of Social Services filed an application for Medicaid benefits on behalf of
Appellant. Appellant's application was denied, and she appealed. A representative from APS
represented Appellant at her hearing before a Department of Health and Human Services Hearing
Officer. The Hearing Officer affirmed the denial of Medicaid eligibility. Appellant died at some
point during this process. As a result, APS closed its file and declined to file an appeal of the
Hearing Officer's decision. Legal counsel for Marriott International, Inc. filed this appeal with the
Administrative Law Judge Division.(1) However, by letter dated February 18, 1999, Stacey L.
Kraftchick, Attorney for Marriott International, advised this tribunal that Marriott International
wishes to withdraw its appeal.
IT IS THEREFORE ORDERED that the above-captioned case is hereby dismissed with
prejudice.
