ORDERS:
ORDER OF DISMISSAL
Petitioner filed a notice of appeal in the above-captioned matter with
the Administrative Law Court on June 12, 2006. On July 6, 2006, at the request
of the parties, the court held this matter in abeyance to permit the parties additional
time to reach a resolution. On October 10, 2006, Petitioner filed a letter
with the Court requesting his case be dismissed so that he may proceed with the
fair hearing process with the Department of Health and Human Services.
Therefore, with no objection from the Respondent and for good cause shown, it
is hereby
ORDERED that this matter is DISMISSED without prejudice.
IT IS SO ORDERED.
