ORDERS:
ORDER OF REMAND
This matter is before the Administrative Law Judge Division (Division) pursuant to the
Appellant’s Notice of Appeal filed on December 23, 2003. The Department of Corrections
(Department) filed a Motion for Remand with the Division on February 13, 2004, which set forth
that the Department requests that this matter be remanded to the Department so that it may
properly respond to the Appellant’s grievance as it has determined that the Department’s rationale
in its previously issued final agency decision was erroneous. Therefore,
IT IS HEREBY ORDERED that this matter be REMANDED to the Department for the
Department to take the appropriate action consistent with this opinion within thirty (30) days
from the date of this Order.
IT IS FURTHER ORDERED that the Appellant be afforded the right to re-grieve his
custody status once the Department has re-issued its final agency decision.
AND IT IS SO ORDERED.
