ORDER OF DISMISSAL

This matter is before the South Carolina Administrative Law Judge Division ("Division") for a contested case hearing. In a letter dated January 10, 2000, counsel for South Carolina Department of Revenue ("Petitioner") notified the Division that a contested case hearing was no longer necessary, as R.L. Jordan Oil Company, of North Carolina, Inc. ("Respondent") paid the monetary penalty assessed by Petitioner. Petitioner further stated that Respondent does not wish to move forward with the contested case proceeding relative to the above-captioned matter. The letter is attached hereto and incorporated as Exhibit A. By virtue of Petitioner's request for dismissal of said request for contested case hearing, there appears to be no further controversy for consideration.

THEREFORE, IT IS ORDERED that the above-captioned case matter is hereby DISMISSED WITH PREJUDICE.

AND IT IS SO ORDERED.
