ORDERS:
CONSENT ORDER
This matter came before the Court based on the South Carolina
Department of Revenue's issuance of citations and a Final Department Determination to
Respondents for forty-eight violations of S.C. Code Ann. Section 12-21-2791 (Supp.
1998) that occurred during November, 1998. Respondents appealed the Department
Determination issued July 7, 1999, seeking review of the violations charged and the
penalties imposed in the amount of $24,000.00 arguing the violations did not occur.
Prior to the hearing scheduled, the parties resolved this matter. That
resolution is incorporated in this Order:
- For the violations charged for November, 1998, Respondents agree
to pay a penalty in the amount of $20,000. These payments will
be remitted to the Department no later than 5:00 pm for the
payment dates and in the amounts noted below:
January 4, 2000 $5,000.00
March 1, 2000 $5,000.00
June 1, 2000 $5,000.00
August 1, 2000 $5,000.00
- Based on the facts of this case and in consideration of the above,
the Department agrees to waive the remaining penalties.
- The parties further agree that the foregoing constitutes the full and
final resolution of this matter.
I find this agreement to be fair and equitable, approve such agreement, and
hereby Order its adoption. This Court retains continuing jurisdiction to enforce this
Order. Therefore this matter is DISMISSED WITH PREJUDICE.
AND IT IS SO ORDERED.
