ORDERS:
CONSENT ORDER
On April 8, 1997, Agents for the South Carolina Law Enforcement Division observed
premises at 620 Poole Street, Hartsville, South Carolina, containing machines licensed under S.C.
Code Ann.§ 12-21-2720(A)(3) (Supp. 1997). The Agents alleged that rooms containing machines
were not separated by exterior walls or fire walls. Petitioner cited Respondents with an
administrative violation for violating S.C. Code Ann. § 12-21-2804(A) (Supp. 1997).
Respondent Dixie Food Mart, Inc., d/b/a Dixie Amusements and the Petitioner have reached
an agreement on this contested matter. Respondent Dixie Food Mart, Inc., d/b/a Dixie Amusements
agrees to the revocation of all class III video poker licenses issued to it which were on the premises
of 620 Poole Street at the time of the inspection on April 8, 1997, and agrees not to operate on the
premises at 620 Poole Street, Hartsville, South Carolina, any machine licensed under S.C. Code Ann.
§ 12-21-2720(A)(3) (Supp. 1997) for a period of six months from July 1, 1998. Respondent Dixie
Food Mart, Inc., d/b/a Dixie Amusements further agrees to pay taxes in the amount of $500.00 to
the South Carolina Department of Revenue within thirty days of July 1, 1998, in order to resolve this
contested matter between it and the Department.
I find that the agreement of the parties is a satisfactory resolution of the contested matter
between the parties, is fair and reasonable, and hereby order its adoption.
