SETTLEMENT ORDER (Dismissal)

This matter comes before me upon motion of both parties that a full settlement has been reached and approval of this office is sought. Respondent was cited for a violation under the Video Game Machines Acta for advertising under S.C. Code Ann. §12-21-2804(B) (1997 Supp). The parties have resolved the maters in issue and the agreement is incorporated in this Consent Order.

The agreement between the parties is as follows:

1. Respondent agrees to remove the exterior sign with the words

"Jackpot Video" on the front of its business at 1111 Main Street in

Summerville, South Carolina, within thirty (30) days of this Order.

2. Respondent agrees that it will not install a sign that would be

Considered advertising for video poker, so long as the law prohibits

Such conduct.

3. Respondent agrees to pay a negotiated fine of $1,000 to Petitioner

Within thirty (30) days of the signing of this Order by the

Undersigned Administrative Law Judge.

I find that this settlement is fair and equitable to all parties, and therefore approve such settlement and Order its adoption.

This case is herewith dismissed, with prejudice.
