ORDERS:
ORDER AND DECISION
This matter is before the Administrative Law Judge Division (Division) pursuant to S.C.
Code Ann. § 1-23-600(E) (Supp. 1996); S.C. Code Ann.§§ 12-21-2748, 12-21-2738 and 12-54-40(b)(3) (Supp. 1996). The South Carolina Department of Revenue (Petitioner) found that Collins
Entertainment Corporation, at Frank's Oasis Bar and Grill (Respondent), maintained machines for
use under S.C. Code Ann. § 12-21-2720(A)(3) (Supp. 1996) and located at 27 Archer Road, Hilton
Head, South Carolina. On November 22, 1996, Petitioner inspected the location and cited
Respondent for failure to have owner identification affixed to each stations of a multistation Class
III video game machine in violation of S.C. Code Ann. § 12-21-2748.
After notice to all parties, a hearing was conducted on April 3, 1998.
Prior to the commencement of testimony, the parties reached an agreement in which the
Petitioner agreed to dismiss the citation because the Class III video game machine was a multistation
machine which had owner identification affixed to the machine. Separate owner identification was
not required for each licensed station of the machine.
IT IS THEREFORE ORDERED, that this action is dismissed with prejudice.
AND IT IS SO ORDERED.
