ORDERS:

ORDER AND DECISION

This matter is before the Administrative Law Judge Division (Division) pursuant to S.C. Code Ann. § 1-23-600(E) (Supp. 1996); S.C. Code Ann. §§ 12-21-2802 and 12-54-40(b)(3) (Supp. 1996). The South Carolina Department of Revenue (Petitioner) found that Archer Property, Inc., (Respondent), maintained machines for use under S.C. Code Ann. § 12-21-2720 (Supp. 1996) and located at 27 Archer Road, Hilton Head, South Carolina. Specifically, the Petitioner found that five of the machines located on this premiss had no prominently displayed signs citing penalties as mandated by S.C. Code Ann. § 12-21-2802 (Supp. 1996).

The Petitioner requested the Division uphold its determination that Archer Property, Inc., violated S.C. Code Ann. § 12-21-2802, failed to post penalty signs on five machines licensed under S.C. Code Ann. § 12-21-2720, and that the Petitioner's proposed assessment of a $1,500 fine was proper. The Respondent requested that the Division dismiss the administrative violation. After notice to the parties, a hearing was conducted on April 3, 1998.

Prior to the commencement of testimony, the parties stipulated that Respondent, Archer Property, Inc., will pay a fine of $1,500.

IT IS THEREFORE ORDERED, that Respondent Archer Property, Inc. are to pay a fine of $1,500, payable within fifteen (15) days from the date of this Order.

AND IT IS SO ORDERED.
