CONSENT ORDER

On November 1, 1996, Agents of the South Carolina State Law Enforcement Division observed premises at 430 North Main Street, Whitmire, South Carolina, containing machines licensed under S.C. Code Ann § 12-21-2720(A)(3) (Supp. 1996). The Agents alleged that the four game rooms did not have employees on the premises even though these locations were open for business. Petitioner cited Respondents with an administrative violation for violating S.C. Code Ann. § 12-21-2804(A) (Supp. 1996).

The parties have reached an agreement to resolve this contested matter. Respondents Tim's Amusements, Inc., and Charles Farr agree not to operate or to allow the operation on the premises designated as T&K, Charlies, and Deloris at 430 North Main Street, Whitmire, South Carolina, any machine licensed under S.C. Code Ann. § 12-21-2720(A)(3) (Supp. 1996) for a period of six months from November 15, 1997. The Respondent Tim's Amusements, Inc., further submits to the revocation of all licenses issued by the Department under S.C. Code Ann. 12-21-2710(A)(3) (Supp. 1996) that were on the premises of 430 North Main Street, Whitmire, S.C., on November 1, 1996, and further agrees to deliver to the S. C. Department of Revenue by November 15, 1997, class III license numbers 3804333, 3804332, 380334, 3804330, 3804331.

The South Carolina Department of Revenue agrees to waive all proposed monetary assessments for this violation.

I find that the agreement of the parties is a satisfactory resolution of the contested matter between the parties, is fair and reasonable, and hereby order its adoption.
