ORDER OF DISMISSAL

This matter is currently pending before the Administrative Law Judge Division pursuant to a request for a hearing by Michael W. Gault, ("Respondent") regarding the South Carolina Department of Revenue's ("Department") determination that Respondent had violated S.C. Code Ann. § 12-21-2703 of the Video Game Machines Act by operating machines licensed under S.C. Code Ann. § 12-21-2703(A)(3) without having a license pursuant to the provisions of Chapter 36 of Title 12, The Department imposed a monetary penalty of $300.00 upon the Respondent. On September 29, 1997, the Department filed a Notice and Motion to Dismiss stating that the Respondent had paid the penalty imposed by the Department and there was no longer an issue between the parties. Accordingly, upon good cause shown,

IT IS HEREBY ORDERED that the Motion is granted and this matter be and hereby is dismissed, and

IT IS FURTHER ORDERED that the hearing scheduled for October 15, 1997 at 11:00 a.m. at the Anderson County Courthouse, Anderson, South Carolina is canceled.

AND IT IS SO ORDERED.
