ORDERS:
ORDER OF DISMISSAL
This matter is currently pending before the Administrative Law Judge Division pursuant
to a request for a hearing by H S Enterprises of Rock Hill, Inc., ("Respondent") regarding the
South Carolina Department of Revenue's ("Department") determination that the Respondent
violated S.C. Code Ann. § 12-21-2802 by failing to post penalty signs for machines licensed
pursuant to S.C. Code Ann. § 12-21-2720(A)(3) and for violating S.C. Code Ann. § 12-21-2748
by failing to have owner identification on a coin-operated device licensed pursuant to S.C. Code
Ann. § 12-21-2720(A)(3). The Department imposed monetary penalties totaling $10,000.00
upon the Respondent. On September 17, 1997, the Department filed a Notice and Motion to
Dismiss stating that the Respondent had paid the penalties imposed and that there were no longer
any issues between the parties. Upon consent of the Respondent and with good cause shown,
IT IS HEREBY ORDERED that the Motion is granted and this matter be and hereby is
dismissed, and
IT IS FURTHER ORDERED that the hearing scheduled for October 20, 1997 at 3:00
p.m. in Columbia, South Carolina is canceled.
AND IT IS SO ORDERED.
