ORDER AMENDING DECISION

This matter comes before me upon a Motion For Reconsideration filed July 29, 1997 by Petitioner South Carolina Department of Revenue for reconsideration of the Order of this tribunal dated July 23, 1997. Respondents have filed no response to this motion. After careful consideration and review, Petitioner's motion is granted and the previous Order is hereby amended to revoke the licenses of the ten (10) video poker machines involved.

The first paragraph of the Order provision at page eight is amended to state:

Based upon the foregoing Findings of Fact and Conclusions of Law, it is hereby

ORDERED that the Department properly issued a citation against Respondent Charles Raley, Jr. d/b/a Raley's 903 Superette for violation of S.C. Code Ann. § 12-21-2804(A) and 27 S.C. Code Regs. 117-190. The following ten (10) licenses of the video poker machines located in "Ann's Place" and "Charlie's Place" on June 13, 1996, are hereby revoked:

IT IS THEREFORE ORDERED that Petitioner's Motion for Reconsideration is hereby granted and the Order filed by this tribunal dated July 23, 1997 is hereby amended.
