CONSENT ORDER

On June 13, 1996, Revenue Officers observed three premises at 1525 13th Avenue North, North Myrtle Beach, South Carolina, containing machines licensed under S.C. Code Ann. § 1221-2720(A)(3) (Supp. 1996) that allegedly did not have an employee on the premises even though the premises were open for business. Petitioner cited Respondent with an administrative violation for violating S.C. Code Ann. § 12-21-2804(A) (Supp. 1996). Respondent consents to the revocation of the licenses cited below. Respondent agrees not to operate or to allow the operation on the premises of the rooms cited below any machine licensed under S.C. Code Ann. § 12-21-2720(A)(3) (Supp. 1996) for a period of six months from March 24, 1997.

The Respondents consents to the revocation of the following Class III video poker licenses that were on the premises of Rooms B, F, and H, 1525 13th Avenue North, North Myrtle Beach, South Carolina on June 13, 1996.

Respondent further consents to the effective date of revocation of the permits cited above to be midnight on Saturday, March 22, 1997, and will deliver these permits to the Department of Revenue on Monday, March 24, 1997.

Petitioner agrees not to seek the revocation of the permits that were in other rooms located at 1525 13th Avenue North, North Myrtle Beach, South Carolina and further agrees not to seek a monetary penalty for this alleged offence. Petitioner further avers that the revocation of the licenses cited above does not affect the machines to which those licenses are attached, and those machines may be re-licensed on other premises. Petitioner further agrees that these revocations do not affect the licensing or re-licensing of machines in any other premises located at 1525 13th Avenue North, North Myrtle Beach, South Carolina other than the rooms known as B5 F, end H.

The parties agree that this is a settlement of a contested ma~er and is not an admission of wrongdoing by the Respondent.

I find that the agreement of the parties is a satisfactory resolution of the contested ma~er between the parties, is fair and reasonable, and hereby order its adoption.

IT IS SO ORDERED.
