ORDERS:
ORDER AND DECISION
This matter was before the Administrative Law Judge Division for an administrative violation
issued to O & J Management, Inc., located at 477 East Blackstock Road, Spartanburg, South
Carolina, by the South Carolina Department of Revenue. The Department alleged that O & J
Management, Inc.., offered or allowed to be ordered a special inducement to a person for the
playing of machines licensed under S.C. Code Ann. § 12-21-2720(A)(3), and failed to limit the
cash value of credits for each free game to five cents. After notice to the parties, a hearing was
scheduled for February 3, 1997.
Prior to the hearing, Counsel for both parties reached an agreement in settlement of the above
referenced case. The Respondent admitted both violations, and the Department agreed to accept
$250.00 each for the two violations, for a total penalty of $500.
I find such agreement to be a fair resolution of the contested case.
Based upon the agreement of the parties, it is
ORDERED, that O & J Management, Inc., located at 477 East Blackstock Road, Spartanburg,
South Carolina, has violated the provisions of S.C. Code Ann. § 12-21-2804(B) (Supp. 1995) by
offering an inducement, and 12-21-2791 (Supp. 1995) by failing to limit the cash value of credits
to five cents per game. It is further ORDERED that the Respondent shall pay the imposed fine of
$500 to the Department within ten (10) days of this Order.
AND IT IS SO ORDERED.
