CONSENT ORDER

This matter comes before the Court upon the motion of petitioner South Carolina Department of Revenue and Taxation seeking to have respondents held in contempt for failing to comply with this Court's orders in this matter dated June 22 and June 23, 1995. It appears that the parties have resolved this matter through agreement.

Petitioner agrees to withdraw, with prejudice, the citation against Edwin S. Alewine issued on December 1, 1995, for violating S. C. Code Ann. § 12-21 -2804(A) (Supp. 1994) by using licenses on machines in an establishment within six months of the date of license revocation in that same establishment, and withdraw the proposed assessment for that violation of $22,500. All other regulatory violations and proposed assessments issued on December 1, 1995, will remain in effect. Respondents have the right to contest those violations and assessments through the administrative process.

Respondents agree to comply with S. C. Code Ann. § 12-21-2804(A) (Supp. 1994) by not operating video poker machines on the premises where this Court earlier ordered the revocation of video poker licenses for a period of six months.

I find this settlement agreement to be a fair resolution of the contested issues, and I hereby order its adoption.

Accordingly, based upon the consent of the parties, it is ordered that respondents Great Games, Inc., Edwin S. Alewine, and Tina Alewine are prohibited from operating machines licensed under S. C. Code Ann. § 12-21-2720(A)(3) (Supp. 1994) or permitting the operation of those machines in the structures located at 2213 Augusta Road, West Columbia, South Carolina, and 1221 Augusta Road, West Columbia, South Carolina, until June 1, 1996.

AND IT IS SO ORDERED
