ORDERS:
CONSENT ORDER
This matter was initiated by a citation issued by the South Carolina Law Enforcement Division against
Respondents on July 8 and July 12, 1999, for violations of S.C. Code Ann. Section 12-22-740 (Supp. 1999)
for "operating as a casino." The South Carolina Department of Revenue (Department) issued its Final
Department Determination sustaining this violation and seeking various penalties. Respondents appealed
the matter and it was transmitted to the Administrative Law Judge Division (Division).
Prior to the hearing on this matter, the Department and End of the Rainbow of Carolina, Inc. entered into an
agreement resolving the matter between them. That agreement has been approved and ordered by this
tribunal. Also, prior to the hearing, United Amusements, Inc. and the Department resolved the matter. That
resolution is set forth below.
The agreement between the parties is as follows:
- For the violations at issue, United Amusements, Inc. agrees to remit to the Department a fine in the
amount of $5,000.00. This amount will be paid to
the Department no later than 5:00 p.m. on April 20, 2001.
- In consideration of the above, the Department agrees to waive the remaining penalties sought for these
violations.
I find this agreement to be fair and equitable, approve such agreement, and hereby Order its adoption. This
court retains continuing jurisdiction to enforce this Order. Further, this matter is resolved With Prejudice.
