This matter is before me pursuant to Petitioner's Motion for dismissal.



A review of Petitioner's Motion reflects that:



1. The Petitioner does not wish to proceed with any action against the Respondent James McDonald, III, d/b/a Coastal Video Gaming, et al. In light of the Order of the Administrative Law Judge Division in the matters of S. C. Dept. of Revenue v. J. B. Smith, Jr., et al (00-ALJ-17-0543-CC) and S. C. Dept. of Revenue v. Franklin L. Cook, et al. (00-ALJ-17-0542-CC).



2. The Petitioner requests that the Court dismiss this action as to the Respondent James McDonald, III, d/b/a Coatal Video Gaming, et al.



3. Counsel for the Respondent James McDonald, III, d/b/a Coastal Video Gaming, et al. has

been consulted regarding this Motion and has no objection to the dismissal of the case against his client.



Wherefore, based upon the foregoing, it is hereby



ORDERED that this case is dismissed.













AND IT IS SO ORDERED.
