CONSENT ORDER

This matter was initiated by citations issued by the South Carolina Law Enforcement Division (SLED) against Respondents on April 20, 2000 for violations of S.C. Code Ann. § 12-21-2802 and 12-21-2732 (Supp. 1999). The South Carolina Department of Revenue (Department) issued its Final Determination sustaining these violations and imposing various monetary penalties. Respondents appealed the matter and it was transmitted to the South Carolina Administrative Law Judge Division.

Prior to the hearing, the parties entered into an agreement resolving the matter. That agreement is incorporated in this Order.

The agreement between the parties is as follows:

1. For the violations of Sections 12-21-2732, 12-21-2720 and 12-21-2802 on April 20, 2000, Respondent agrees to pay fines in the amount of $2850 ($2500 for failure to license and $350 for failure to post penalty signs). Respondents further agree to remit this amount to the Department no later than 5:00 p.m. on November 17, 2000.

2. In consideration of the above, the Department agrees to waive the remaining penalties sought for this violation.

3. The parties agree that this settlement is with prejudice.

I find this agreement to be fair and equitable, approve such agreement, and hereby Order its adoption. This court retains continuing jurisdiction to enforce this Order.

AND IT IS SO ORDERED.
