ORDER OF DISMISSAL

On August 25, 2000, Petitioner filed a Motion to Dismiss and Remand on the grounds that Petitioner does not wish to proceed with any action against Respondent, Tim's due to a South Carolina Supreme Court decision in the matter of S.C. Dept. of Revenue v. Collins, 530 S.E.2d 635, 340 S.C. 77 (2000) and that the Class III video game machine licenses at issue in this case have all expired.



Further, due to the Petitioner's unsuccessful attempts to contact or locate Respondent Wu Feng Zhang ("Zhang"), and Zhang's failure to appeal the Department's Final Agency Determination, Petitioner requests dismissal of the action as to Respondent, Tim's and remand of the remainder of the action for further administrative proceedings by Petitioner.



IT IS HEREBY ORDERED that Petitioner's Motion to Dismiss and Remand is hereby granted.



AND IT IS SO ORDERED.
