CONSENT ORDER

This matter is before the Court based on the South Carolina Department of Revenue's issuance of citations and a Final Department Determination to Respondents for alleged violations of S.C. Code Ann. § 12-21-2804(C) and S.C. Code Ann. § 12-21-2791. Respondents have appealed the Department Determination seeking review of the violations charged and the penalties imposed. At this juncture, the Department of Revenue wishes to sever and remand the alleged violation of S.C. Code Ann. § 12-21-2791 to the Department and continue with a contested case hearing on the issues presented in the appeal of the alleged violation of S.C. Code Ann. § 12-21-2804(C).

Upon motion of the Department and with the consent of the Respondents, the alleged violation of S.C. Code Ann. § 12-21-2791 is severed and remanded to the Department; and, thealleged violation of S.C. Code Ann. § 12-21-2804(C) shall proceed to a contested case hearing.

AND IT IS ORDERED.
