CONSENT ORDER

On August 11, 1999, Respondents, C. C. Electronics, and James R. McDonald, were cited by the South Carolina Department of Revenue for violation of Section 12-21-2804(A) and Regulation 117-190 for having no employee on the premises of Lady Bug 1, 2, and 5, 3061 Mt. Zion Road, Little River, South Carolina during business hours. No employees were on these premises as required by Section 12-21-2804(A)

Respondents and Petitioner have reached an agreement on this contested matter. Respondents agree to the revocation of all licenses issued to it under the provisions of S.C. Code Ann. Section 12-21-2720(A)(3)(Supp. 1997) which were on the premises at Lady Bug 1, Lady Bug 2, and Lady Bug 5, at the time of the inspection on July 10, 1999. These licenses are listed in the final determination, which is made a part of this order. Respondents agree not to operate

on the premises of those rooms, any machine licensed under S.C. Code Ann. Section 12-21-2720(A)(3)(Supp. 1997) for a period of six months beginning fifteen (15) days from May 3, 2000. C.C. Electronics further agrees to pay $1,500.00 to the South Carolina Department of Revenue within ten days from the date of this order, in order to resolve this contested matter between them and the Department.









I find that the agreement of the parties is a satisfactory resolution of the contested matter between the parties, is fair and reasonable, and hereby order its adoption.

IT IS SO ORDERED.
