The above-entitled case is pending before the Administrative Law Judge Division. On October 15, 1999, a letter was received from Daphne Dell Sipes, Attorney for Respondent, with the enclosure of a letter from Cpl. R. McBrayer, of the City of Charleston Police Department, a protestant in this matter wherein he is withdrawing his protest. A copy of said letter is attached hereto. Except for the protest filed in this matter by Cpl. R. McBrayer, the Department would have issued the off-premises license or permit for this location. There being no further controversy,



IT IS HEREBY ORDERED that the above-captioned case is hereby dismissed.
