ORDERS:
ORDER OF DISMISSAL
This matter comes before me pursuant to S.C. Code Ann. § 61-4-520 (Supp. 1998) and 23 S.C. Code Ann. Regs. 7-90
(1976) following the Petitioner's request for a contested case hearing. The Petitioner, Bill J. Harrison, applied for an on-premises beer and wine permit. Several Protestants, however, filed written protests with the South Carolina Department of
Revenue ("DOR"). The DOR transferred this matter to the Administrative Law Judge Division ("ALJD") for a hearing. A
hearing was held on October 15, 1999 at the ALJD in Columbia, South Carolina, after timely notice to the parties and the
Protestants.
The South Carolina Department of Revenue moved to dismiss the case because the Petitioner failed to appear for the hearing
and argued that Petitioner's application should be considered withdrawn. The Court waited an additional 15 minutes to see
whether Petitioner would appear; however, neither he nor anyone representing him appeared at the hearing.
IT IS THEREFORE ORDERED that DOR's motion to dismiss is granted and that DOR shall not issue a permit to the
Petitioner for an on-premises beer and wine permit for his establishment located at 2734 Ira Kinard Road, Prosperity, South
Carolina.
AND IT IS SO ORDERED.
