ORDER OF DISMISSAL

This matter is before the South Carolina Administrative Law Judge Division ("Division") on the application of Dorothea Bell, d/b/a Red Bay Grocery ("Applicant"), for an off-premises beer and wine permit for Red Bay Grocery, located at 204 E. Red Bay Road, Sumter, South Carolina. The application was protested by Louis Flemming and Harry Smith of the Red Bay Association ("Protestors"). After notice to the parties, a hearing was scheduled for Tuesday, September 8, 1998. The applicant and protestors failed to appear at the hearing. Since the applicant failed to appear at the hearing, her application is deemed abandoned.

IT IS THEREFORE ORDERED that the above-referenced contested case is DISMISSED.

AND IT IS SO ORDERED.
