ORDER OF DISMISSAL

In the above-captioned matter, Petitioner applied for a retail liquor license at 946 Harden Street, Columbia, South Carolina. Because of public protests concerning suitability of location, the Department denied Petitioner's application and submitted the case to the Administrative Law Judge Division for a contested case hearing. In its agency transmittal, the Department stated that were it not for public protests concerning suitability of location, it would have issued the license. The hearing in this matter was set for April 8, 1998. However, by letter dated March 19, 1998, Petitioner notified this tribunal that she no longer wishes to contest the Department's denial of her application, as she has rented the proposed location to someone else.

IT IS THEREFORE ORDERED that the above-captioned case is hereby dismissed.
