ORDERS:
ORDER
This matter comes before me pursuant to S.C. Code Ann. § 1-23-310, et seq. (Supp. 1996)
for a hearing pursuant to the application of Juliann Marshall, Kathmar, Inc., d/b/a McJul's. The
petitioner seeks an on-premises beer and wine permit (AI 113159) and a sale and consumption
license (AI 113160) for a restaurant located at 125 Atlantic Avenue, Garden City, South Carolina.
After timely notice to the parties and the protestant, a hearing was held at the Administrative
Law Judge Division on July 24, 1997 in Columbia, South Carolina. The protestant failed to appear
at the hearing or to make a motion for a continuance, thereby, waiving his protest. Therefore, there
is no opposition of record to the petitioner's application.
IT IS HEREBY ORDERED that this matter is dismissed.
IT IS FURTHER ORDERED that the Department of Revenue continue to process the
application of Juliann Marshall, Kathmar, Inc., d/b/a McJul's for an on-premises beer and wine
permit (AI 113159) and a sale and consumption license (AI 113160) for a restaurant located at 125
Atlantic Avenue, Garden City, South Carolina.
AND IT IS SO ORDERED.
