ORDERS:
ORDER AND DECISION
This matter comes before me pursuant to S.C. Code Ann. § 1-23-310 et. seq.(Supp. 1996) for a
hearing pursuant to the application of Ruthie A. Newman, Ruthie's Inc., d/b/a Ruthie's. The petitioner
seeks an on-premises beer and wine permit (AI-109364) at 16291 Choppe Road, Hemingway, South
Carolina, Georgetown County.
After timely notice to the parties and the Protestants, a hearing was held at the Administrative Law
Judge Division on March 5, 1997 in Columbia, South Carolina. There were ten (10) Protestants of record.
Three of the notices sent to the Protestants were returned for insufficient address and the other seven failed
to appear at the hearing or to make a Motion for a Continuance, thereby waiving their protest. Therefore,
there is no opposition of record the petitioner's application.
IT IS HEREBY ORDERED that this matter is dismissed.
IT IS FURTHER ORDERED that the Department of Revenue continue to process the application
of Ruthie A. Newman, Ruthie's Inc., d/b/a Ruthie's for an on-premises beer and wine permit for a location
at 16291 Choppe Road, Hemingway, South Carolina.
AND IT IS SO ORDERED.
