ORDER OF DISMISSAL

Hearing in the above-captioned matter is scheduled for February 4, 1997, at 2:00 p.m.The two protests to the application for an on-premises beer and wine permit (AI 110174) in this matter have been withdrawn. On December 27, 1996, the Court received a copy of a letter addressed to the South Carolina Department of Revenue dated December 13, 1996, from

Rev. Elder B. Holmes, one of the protestants in this matter, stating that he is withdrawing his previous letter of protest. The other protestant in this matter is the South Carolina Department of Revenue (DOR). On January 21, 1997, the Court received a letter dated January 17, 1997, from Arlene D. Hand, Attorney for DOR, stating that DOR's protest to the issuance of an on-premises beer and wine permit for the location at 86B Pine Street, Georgetown, South Carolina, is withdrawn. DOR also requests that the hearing in this matter be cancelled.

IT IS THEREFORE ORDERED that the hearing scheduled for February 4, 1997, at 2:00 p.m. is cancelled.

IT IS FURTHER ORDERED that the South Carolina Department of Revenue issue the beer and wine permit applied for upon Petitioner's payment of the prescribed fee and bond.

IT IS FURTHER ORDERED that the above-captioned case bearing Docket Number

96-ALJ-17-0546-CC is dismissed.

AND IT IS SO ORDERED.
