ORDER OF DISMISSAL

This matter is before me at the request of Roosevelt Daney, Sr., Petitioner in the above matter. A letter dated December 13, 1996, was filed with the Court on December 19, 1996, by Petitioner, requesting that the hearing in this matter scheduled for January 9, 1997, at 11:30 a.m. be cancelled. Petitioner's letter of December 13, 1996, is attached hereto and made a part of this Order.

IT IS THEREFORE ORDERED that the hearing in the above matter scheduled for January 9, 1997, at 11:30 a.m. is cancelled and that the above-captioned case bearing Docket Number 96-ALJ-17-0474-CC is hereby dismissed.

AND IT IS SO ORDERED

Dear Sir:

This letter is in reference to a court hearing that has been scheduled at 11:30 a.m. on January 9,

1997. I am the owner of the Daney Grocery Store. Earlier this year I applied for a beer/wine license for the store. My application for the license was rejected by the Department of Revenue because there is lack of restroom facilities. I was give an option to accept the denial of my

application or request a hearing. I have always fully accepted the denial. The request for a

hearing was an error. I had someone type a letter for me supposedly stating I have accepted

the denial. Apparently, the typist misunderstood or accidentally typed the request for a hearing.

I did not read the complete letter after she typed it for me because I thought she stated my

acceptance. So therefore, I signed the letter. I later received a letter stating a court hearing date

which was a surprise to me.

As I stated previously, I clearly understand the reason for not receiving my beer/wine license.

I have no reason to appeal that decision. Again, the hearing request is an error. I would appreciate a cancellation of the hearing. Please contact me at (803) 473-3522 if you need any additional information.
