ORDER OF DISMISSAL

A hearing in this matter was held at 10:30 a.m. on November 22, 1996, with a Notice of Hearing previously provided to all parties and protestants more than thirty days prior to the hearing date.

Kenneth E. Allen, Esq., Attorney for Petitioner, was present at the hearing. The Department of Revenue (DOR), excused from appearance by an order dated October 14, 1996, stated in its Transmittal Form dated September 27, 1996, that DOR would have issued the license except for the license having been protested. No protestant attended the hearing and therefore, the protest is deemed abandoned. There being no opposition, the Petitioner moved for a dismissal, which motion was granted.

Therefore, IT IS ORDERED that the above-captioned case be and hereby is dismissed due to this license not being protested.

AND IT IS SO ORDERED.
