ORDERS:
ORDER OF DISMISSAL
In the above-captioned matter, protestants, John H. Rickenbacker, Robert McDonald, and
Sinclair R. Abraham, Sr., have advised the Administrative Law Judge Division, by letters filed on
August 28, 1996 and August 30, 1996, that the protestants withdraw their protests to petitioner's
application. (These letters are hereby incorporated by reference.) The protestants initially
opposed the issuance of an off-premises beer and wine permit (AI 109747) to T. Dayle Bolen, D
& H of Orangeburg, LLC, d/b/a Bo Jo Markets. Upon withdrawal of these protests, there is no
opposition of record to the petitioner's application. As a result, a hearing is no longer necessary.
IT IS THEREFORE ORDERED that the hearing scheduled for Tuesday, October 8,
1996 is hereby canceled.
IT IS FURTHER ORDERED that this matter is dismissed and that the Department of
Revenue continue to process the application of T. Dayle Bolen, D & H of Orangeburg, LLC,
d/b/a Bo Jo Markets for an off-premises beer and wine permit.
AND IT IS SO ORDERED.
