ORDERS:
ORDER OF DISMISSAL
In the above-captioned matter, protestant Chief Benny L. Webb of the Lancaster County
Police Department has advised the Administrative Law Judge Division by letter dated October 4,
1996 that the protestant withdraws his protest to petitioner's application. (This letter is hereby
incorporated by reference.) By agreement dated October 2, 1996, this tribunal is further advised
that the Southside Crime Watch and petitioner James A. Boykin have come to an agreement that
the issuance of an off-premises beer and wine permit would be in the best interest of the
community, rather than the issuance of an on-premises beer and wine permit. (This agreement is
hereby incorporated by reference.)
Upon withdrawal of the protests, there is no opposition of record to the issuance of an off-premises beer and wine permit to the Petitioner. As a result, a hearing is no longer necessary.
IT IS THEREFORE ORDERED that the hearing scheduled for Tuesday, October 8,
1996 is hereby canceled.
IT IS FURTHER ORDERED that this matter is dismissed and that the Department of
Revenue process the application of James A. Boykin, d/b/a Connor Street Grocery, for an off-premises beer and wine permit, rather than an on-premises beer and wine permit.
AND IT IS SO ORDERED.
