ORDER OF DISMISSAL

This matter comes before me pursuant to S.C. Code Ann. § 1-23-310, et seq. (Supp. 1995) for a hearing pursuant to the application of Judith A. Hardee, d/b/a BP Mini Market. Petitioner seeks an off-premises beer and wine permit (AI 109004) for a convenience store located at 1032 Sea Mountain Highway, within the city of North Myrtle Beach, Horry County, South Carolina.

After timely notice to the parties and the protestant, a hearing was held at the Administrative Law Judge Division on September 3, 1996 in Columbia, South Carolina. Reverend Floyd A. Collins of the Chapel by the Sea Baptist Church, the protestant of record, failed to appear at the hearing or to make a Motion for a Continuance, thereby, waiving his protest. Therefore, there is no opposition of record to the petitioner's application.

IT IS HEREBY ORDERED that this matter is dismissed.

IT IS FURTHER ORDERED that the Department of Revenue continue to process the application of Judith A. Hardee, d/b/a BP Mini Market for an off-premises beer and wine permit for a convenience store located at 1032 Sea Mountain Highway, within the city of North Myrtle Beach, Horry County, South Carolina.

AND IT IS SO ORDERED.
