ORDERS:

CONSENT ORDER OF DISMISSAL

This contested case comes before the undersigned by way of an agency transmittal from the South Carolina Department of Health and Environmental Control (DHEC) directing the conduct of a hearing due to the appeal by Petitioners Doug Darby, Jr., and Catawba Laboratories of the revocation of Petitioners' laboratory certification. Prior to a hearing being held, the Petitioners wish to have this contested case dismissed and agree to voluntarily relinquish its laboratory certifications for all parameters. The parties agree that the relinquishment will be effective as of March 31, 2000 and that all sampling and analyses conducted by Petitioners during the month of March will be completed by that time.

Accordingly, by and with the consent of the parties, it is ordered and agreed that this contested case is dismissed.

AND IT IS SO ORDERED.
