ORDER OF DISMISSAL

NOW COME the parties to this contested case notifying the Court that they have reached an agreement to settle this matter and consent to the case being dismissed.

The South Carolina Department of Health and Environmental Control (Department/DHEC) has recertified Columbia Analytical Laboratories (Columbia) to perform analyses of The Purgeables (CG/MS) 624 and 8260A. The appeal by Columbia of the Department's decision concerning these methods of lab analyses is now moot and the parties request the Court to dismiss the appeal and close this case.

THEREFORE IT IS ORDERED by and with the consent of the parties that this appeal is dismissed and the case is closed and removed from the docket.

AND IT IS SO ORDERED.
