ORDERS:
ORDER OF DISMISSAL
The above-entitled case is pending before the Administrative Law Judge Division. On May
30, 1997, a letter was received from Wesley M. Jaynes, Agent for Petitioner, stating, "After much
deliberation concerning ImageTrust's role in the protest of this Certificate of Need, I have come to
the conclusion that further expenditure by this company is pointless. I have just recently been made
Chief Executive Officer of this Corporation and have had to come up to speed with the legal issues
concerning this company rather quickly. And frankly, in going over the issues in this case I cannot
in good conscience continue this company's objections." Therefore, with your permission I would
like to have this letter serve as my formal retraction of ImageTrust Columbia's proceedings."
Therefore, IT IS ORDERED that the above-captioned case be and hereby is dismissed.
AND IT IS SO ORDERED.
