The above-entitled case is pending before the Administrative Law Judge Division. On November 13, 1996, a letter was received from M. Elizabeth Crum, Attorney for Petitioner, stating, "On behalf of our client Total Renal Care, we withdraw the appeals of both the Department of Health and Environmental Control's determination to grant a Certificate of Need to Bio-Medical Applications of S.C., Inc., d/b/a Twin Oaks Dialysis Center and to denying a Certificate of Need to Total Renal Care, Inc., d/b/a Westside Dialysis Center."

Therefore, IT IS ORDERED that the above-captioned case be and hereby is dismissed and the hearing which was scheduled for Monday, December 16, 1996, at 2:00 p.m. has been canceled.
