SC Administrative Law Court Decisions

CAPTION:
Hospice of Colleton County, Inc. vs. SCDHEC

AGENCY:
South Carolina Department of Health and Environmental Control

PARTIES:
Petitioner:
Hospice of Colleton County, Inc., (Colleton County)

Respondent:
South Carolina Department of Health and Environmental Control

DOCKET NUMBER:
96-ALJ-07-0297-CC

APPEARANCES:
n/a

ORDERS:

ORDER OF CONSOLIDATION

These matters are before me pursuant to Petitioner's separate requests for contested case hearings in response to Administrative Orders issued to it by the South Carolina Department of Health and Environmental Control (DHEC). In their Prehearing Statements, both Hospice of Colleton, Inc., and DHEC have requested that the cases be consolidated. Because the DHEC Administrative Orders concern the identical factual situation relating to the Department's denial of a Certificate of Need ("CON") for Hospice of Colleton County, Inc., to expand its Hospice program to provide home health services to terminally ill patients in Colleton, Jasper and Hampton counties, judicial economy dictates that the matters be consolidated into one contested case pursuant to Rule 42(a) of the South Carolina Rules of Civil Procedure.

AND IT IS SO ORDERED.
