ORDERS:
CONSENT ORDER OF DISMISSAL
UPON MOTION OF THE PETITIONERS, by and through their counsel, Margie L. Bright,
Hospice of Colleton County, Inc. moves for a dismissal of its appeal without prejudice. The
Respondent, through its counsel, H. Bowen Woodruff, consents to this dismissal of the appeal
without prejudice.
The terms of the agreement between Petitioner and Respondent are as follows: Hospice of
Colleton County, Inc. shall be permitted to amend its original applications relating to Colleton,
Hampton and Jasper Counties and DHEC shall evaluate these Amended Certificate of Need
applications in their entirety. In the event the Amended Certificate of Need applications are
declined by DHEC the petitioners shall then have an opportunity to appeal their administrative
decision before the Administrative Law Judge Division.
THEREFORE, BY CONSENT OF PETITIONER AND RESPONDENT, the appeal shall be
dismissed without prejudice and the Respondent shall review the amended applications that shall
be presented by the Petitioners to DHEC for review.
AND IT IS SO ORDERED.
