ORDERS:
CONSENT ORDER
This matter comes before the Administrative Law Judge upon the Certificate of Need (CON)
application of Abbeville Home Care (AHC), to establish a home health agency in McCormick
County, South Carolina. Abbeville Memorial Hospital sought through its application to provide a
new service.
In March of 1995, the Petitioner, Abbeville Home Care, filed an application with the South
Carolina Department of Health and Environmental (DHEC/Department) for the one (1) available
Certificate of Need for a home health agency in McCormick County, South Carolina. Department
staff denied the application on June 23, 1995 because it lacked letters of support from the county
physicians and discharge planners that met the criteria required by the 1994 South Carolina Health
Plan.
Since the original application for the CON was received, more specific letters of support have
been forthcoming. It now appears that the parties have agreed to resolve the issues between them
in this Consent Order.
IT IS THEREFORE ORDERED, CONSENTED TO AND AGREED as follows:
The Department shall issue a Certificate of Need to Abbeville Home Care, Abbeville Memorial
Hospital, to provide home health care in the McCormick County service area in accordance with
the CON application submitted by AHC.
AND IT IS SO ORDERED.
