ORDER OF SETTLEMENT AND DISMISSAL

This matter came before the Administrative Law Division pursuant to the petition by Rope Home Health Care (Roper) to review the decision by DHEC not to reissue a license containing Dorchester County in the service area of Roper. A pre-trial conference was conducted during which the parties agreed to try to resolve the issue of whether Roper is complying with its Certificate of Need #SC-87-20 and the State Health Plan. After discussion between the parties, it appears that a settlement has been reached. The Department has re-examined the home health license and has agreed to reinstate Dorchester County into the service area of Roper. The parties are in accord with the settlement proposed.

It is therefore,

ORDERED, ADJUDGED and DECREED that the Department shall reinstate Dorchester County as part of the service area Roper Home Health Care is licensed to serve. Upon reinstatement of the license with Dorchester County included in the service area this matter is

DISMISSED WITHOUT PREJUDICE.

AND IT IS SO ORDERED.
